"Canadian Visitor Explores Religion and Law The University has received a visit from one of the of the world’s leading authorities on the assessment of legal damages. Professor Stephen Waddams. Professor Waddams, a Fellow of the Royal Society of Canada, is the Mallesons Stephen James Visiting Professor of Law at the ANU. He visited the Universities of Sydney, NSW and Wollongong as well as coming to Newcastle to meet Professor Frank Bates. At his “home” university, Toronto, Professor Waddams lectures in contract, legal remedies and law and religion. He said this last field was of considerable importance in Canada, and he could see many similar issues developing in Australia. “The Canadian Charter of Rights contains six references to religion: for example, it guarantees freedom of religion. This has an impact on questions such as Sunday closing, the financing of Catholic education, custody and access cases.” However, he said the major developing area of complexity concerned the rights of native Canadians both Eskimo and so-called “Indians”, such as the Mohawk People. Like the Aborigines of Australia or Maoris of New Zealand, native Canadians held religious beliefs inextricably liked to the land, Professor Waddams said. Looking at the legal structures which try to accommodate the religion, property and the State had led him to particular study of a 19th century English judge, Stephen Lushington. Lushington was Lady Byron’s adviser during her divorce, and Queen Caroline’s defender in the House of Lords when she was accused of adultery. From this sensational career at the Bar, he became a judge in the ecclesiastical courts and in Admiralty, where he laid down many of the principles of assessing damages employed today. Professor Waddams’ Book on Lushington is to be published this year by Cambridge University Press."
